Terms of Service for DailyMax

Please review these Terms of Service ("Terms") before using the DailyMax mobile application and website (the "Service"). By installing or using DailyMax, you agree to these Terms.
1. The Nature of the Service
DailyMax is a self-directed digital wellbeing tool designed to help users build intentional device habits by introducing physical movement tolls and accountability reflection before opening distraction apps. DailyMax is a habit utility; it is not a medical device, addiction treatment program, or psychological therapy service.
- Voluntary Participation: Physical movement challenges (including steps, push-ups, squats, jumping jacks, and planks) are entirely voluntary.
- Consultation with Physician: You should consult a physician or healthcare provider before performing physical exercises, particularly if you have pre-existing cardiovascular, musculoskeletal, or joint conditions.
- Assumption of Risk: You assume all risks associated with performing physical exercises prompted by the App. If you experience pain, dizziness, or shortness of breath, cease physical activity immediately.
- Alternative Tolls: DailyMax provides non-strenuous alternatives (such as Mindful Wait and Focus Sessions) if you are unable to perform physical exercises.
3. Permitted Use & Device Controls
- You agree to use DailyMax solely on devices you own or have authorized parental/administrative permission to manage.
- You acknowledge that enabling the Accessibility Service and Usage Access gives DailyMax permission to monitor foreground package names and display challenge interception screens according to the rules you configure.
- Emergency Overrides are provided to ensure you are never locked out of vital communications, navigation, or critical services. You agree not to hold DailyMax liable for access interruptions.
4. Intellectual Property
All rights, title, and interest in DailyMax (including software source code, character avatars, doodle artwork, logos, and UI designs) remain the exclusive property of the DailyMax development team. You may not decompile, reverse engineer, or redistribute our graphic assets without prior written consent.
5. Limitation of Liability
To the maximum extent permitted by law, DailyMax and its contributors shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from your use of or inability to use the Service.
6. Changes to Terms
We may update these Terms periodically. Continued use of DailyMax following published updates constitutes acceptance of the amended Terms.
